JUDGMENT:

(per Hon'ble Sri Justice G.Narendar)

Heard the learned Standing Counsel for Dr.Y.S.R. Aarogyasri

Health Care Trust appearing for the Appellant and the learned Counsel

appearing for the 1st respondent/writ petitioner.

2. The Chief Executive Officer of Dr.YSR Aarogyasri Health Care

Trust has preferred this intra-Court Appeal being aggrieved by the

directions issued by the learned Single Judge to sanction additional grant

of Rs.25.00 Lakhs over and above the sum of Rs.20.00 Lakhs which was

already granted.

3. Though the matter would have required consideration on the

merits, we do not enter upon the merits of the order of the learned Single

Judge in view of the subsequent development. This Bench is notified

that the writ petitioner/patient passed away even before the surgery could

be taken up. The grants have been sanctioned by both the State Unit

and this Court for effecting the Lungs transplantation. The cause of

action for the writ petition itself does not survive.

4. In that view of the matter, the impugned order of the learned Single

Judge is set aside. The Writ Appeal stands allowed. There shall be no

order as costs.

Consequently, miscellaneous petitions, pending if any, shall stand

closed.
