The Court made the following:

JUDGMENT:

1. The present Appeal is filed against the order dated 06.08.2017 in

I.A.No.471 of 2007 in O.S.No.78 of 2007 passed by the VII Additional District

& Sessions Judge, Vijayawada, Krishna District.

2. On 30.07.2024, the learned counsel for both the parties submitted that

the matter was settled in Lok Adalat. As per the report on record, the matter

was not settled in Lok Adalat. We called for fresh report. The Secretary,

APHCLSC, High Court of A.P., submitted the report reiterating that the matter

was not settled in E-National Lok Adalat held on 11.12.2021.

3. The learned counsel for the appellant appearing through video conference reiterates that as per the instructions, the matter was settled. Consequently the appeal deserves to be closed and suit to be proceeded on merits.

4. The Civil Miscellaneous Appeal is dismissed for want of prosecution.

There shall be no order as to costs. As a sequel, pending applications, if any, shall stand closed.
