O R D E R:
This Writ Petition under Article 227 of the Constitution of
India is filed for the following relief:
"to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus by way of declaring the inaction on the part of the Respondents
2 to 5 in considering the representation dated 01 05 2023 submitted by the 1st petitioner in Spandana programme as illegal arbitrary and caprecious
consequently direct the respondents 2 to 5 to consider the representation dated 01 05 2023 and to provide necessary protection and to pass such..."
2. Heard learned counsel for the petitioners and learned
Assistant Government Pleader appearing for the State.
3. Learned Assistant Government Pleader appearing for the
State on written instructions would submit that both parties were
summoned to the police station, and the unofficial respondent
admitted that he will not interfere with the subject property and
executed a statement to that effect. Therefore, no further action
was taken by the respondent/police in the matter.
4. It appears that the petitioners herein presented a
representation dated 01.05.2023 to the Station House Officer, I
Town Police Station, Ananthapuram, alleging certain acts relating
to threat. In the light of the judgment of the Hon'ble Apex Court in
Lalitha Kumari and State of Uttar Pradesh and others Case, the
Station House Officer is expected to take necessary action on the
said representation.
5. In that view of the matter, the Writ Petition is disposed of,
directing the respondent No.5 to consider the petitioner's
representation dated 01.05.2023 in the light of the judgment of
the Hon'ble Apex Court in Lalitha Kumari and State of Uttar
Pradesh and others1 Case, within a period of two (02) weeks
from the date of receipt of copy of the order.
6. Accordingly, the Writ Petition is disposed of. No order as to
costs.
As a sequel thereto, the miscellaneous petitions, if any,
pending in this Writ Petition shall stand closed.
