This application is filed to grant stay of
execution of the Judgment and decree dated
01.04.2024 passed in M.V.O.P.No.188 of 2020
on the file of Court of Motor Accidents Claims
Tribunal Cum VIII Additional District Judge
Court, at Ongole.
Heard the learned counsel for the
appellant/respondent.
The learned counsel for the
petitioner/appellant contended that the tribunal
failed to consider the contributory negligence of
the deceased and also erroneously took the
monthly income of the deceased at Rs.12,000/-
without there being any proof of it and further
erred in adding future prospects.
Accordingly, considering the contentions,
interim stay is granted on the condition that the
appellant/respondent shall deposit 50% of the
awarded amount as per the decree within eight
(08) weeks from the date of this Order, failing
which, the interim stay granted gets vacated
without any further orders.
