DATE : 1st April 2024

PC:

Mr. Siddharth Luthra, learned Senior Counsel submits that although reliance was placed upon the Judgments rendered by the High Court of Madhya Pradesh, in the cases of Vijay Kumar Jain Vs RBI & Ors. [2024 SCC Online MP 1199], Rajiv Soni Vs ICICI Bank [2023 SC Online MP 2981] and Madanalal Goyal Vs IDBI Bank [W.P.No.4699 of 2024, High Court of Madhya Pradesh], yet in one of the previous Judgments on similar lines rendered by the High Court of Madhya Pradesh in the case of Punjab National Bank Vs Vijay Soni & Anr., has since been challenged before the Hon'ble Apex Court in S.L.P.No.47470 of 2023 in which vide the order dated 14.12.2023, it has been ordered that the impugned Judgment rendered in Punjab National Bank Vs Vijay Soni & Anr., would not be read as a precedent.

In that view of the matter, the learned Senior Counsel very fairly states that, it would be appropriate that we await the outcome of the said S.L.P., as the Judgment in the aforesaid case would determine the fate of the present Writ Petition as well.

In that view of the matter, list on 24.06.2024.

Interim orders granted earlier shall stand extended till the next date of hearing.

DHIRAJ SINGH THAKUR, CJ
