              THE HON'BLE SRI JUSTICE V.SRINIVAS

                 APPEAL SUIT No.1333 of 2000

JUDGMENT:

None appeared for the appellant.

2. Ms.V.Kranthi, learned counsel representing Sri Challa

Gunaranjan, learned counsel for the respondents is present and

insisted for disposal.

3. As could be seen from the record for the last two years

learned counsel for the appellant seeking time on one ground or

other, like seeking time to file paper book etc. On 23.02.2023,

the matter was listed at his request to 07.03.2023. Again on

07.03.2022, listed the matter on his request to 09.03.2023. On

13.04.2022 also learned counsel for the appellant requested

time and listed the matter to 18.04.2022. On that day i.e., on

18.04.2022 also at his request listed the matter to 15.07.2022.

On 15.07.2022 on the request of learned counsel for the

appellant, listed the matter after one week.

4. On 09.09.2022, no representation for the appellant and

learned counsel for the respondents reported ready and on that

listed the matter on 20.09.2022 under the caption 'for

dismissal'.

5. Thereafter, on 23.09.2023 also none appeared for the

appellant and the learned counsel for the respondents reported

ready and this Court categorically made a mention that since

the matter pertains to the year 2000, both the learned counsel

directed to get ready for hearing by the next date of

adjournment. But, today i.e., on 29.09.2023 none appeared for

the appellant and on the other hand learned counsel for the

respondent insisted for disposal.

6. In view of the above circumstances, this Court is of the

opinion that the appellant has no interest to prosecute the

appeal. Hence, the appeal suit is dismissed for default. There

shall be no order as to costs.

7. Interim orders granted earlier if any, stand vacated.

8. Miscellaneous applications pending if any, shall stand

closed.
