CIVIL MISCELLANEOUS APPEAL No.727 OF 2007
JUDGMENT:-
This Civil Miscellaneous Appeal is preferred under
Order XLIII Rule 1 & 2 of Code of Civil Procedure (in short
'C.P.C.') against the impugned order passed in A.S. No.79 of
2005 dated 16.03.2007 by the Principal District, Kadapa,
reversing the judgment and decree passed in O.S. No.175 of
1994 dated 21.06.2004.
When the matter is taken up for hearing, Sri
T.V.S.Kumar, learned counsel for the appellant stated that,
the sole appellant has passed away. Inspite of his best
efforts, he could not get any information about the legal
representatives of the deceased. Hence, he seeks to dismiss
the appeal as abated.
Sri M.N.Narasimha Reddy, learned counsel for the
respondents is present. He also stated that, as the sole
appellant died and no legal representatives are brought on the
record, appeal may be dismissed as abated.
Accordingly, recording the submission of the learned
counsel for the appellant, the Civil Miscellaneous Appeal is
dismissed as abated. No order as to costs.
As a sequel, miscellaneous petitions pending, if any,
shall stands closed.
