CONTEMPT CASE No.1108 of 2023
JUDGMENT:-
This contempt petition was filed alleging the wilful
disobedience of the order dated 16.11.2022 passed in
W.P.No.23818 of 2022. The petitioner in the Writ Petition
claimed an amount of Rs.79,87,899/-.
2. Counter affidavit has been filed by the respondent No.4
stating that the Corporation uploaded the bills for the entire
amount without making 10% deductions to be payable to the
Municipal Corporation.
3. Sri V.Ashok Ram, learned Government Pleader for
Finance for the respondent No.4, further submits that an
amount of Rs.72,35,830/- has been paid to the petitioner and
an amount of Rs.7,52,609/- being 10% has been paid to the
Municipal Corporation and the entire amount has been paid as
per the procedure.
4. Learned counsel for the petitioner admits that
Rs.72,35,830/- has been received by the petitioner, but submits
that the rest amount was also payable to the petitioner.
5. The Court finds that the order has been complied with as
the payment has been made and the payment with respect to
the rest amount has been paid to the Municipal Corporation.
If the petitioner claims the rest amount as well, it is open for the
petitioner to take recourse to the appropriate proceedings.
6. Accordingly, the Contempt Case is closed. No order as to
costs.
As a sequel thereto, miscellaneous petitions, if any pending,
shall also stand closed.
