                   APPEAL SUIT No.445 of 2009

JUDGMENT:

1. On 06.02.2023 and 22.02.2023, there is no representation on

either side and hence, the office is directed to list the matter

under the caption 'for dismissal'.

2. Today i.e. on 20.03.2023 also, despite the matter listed under the

caption for dismissal there is no representation on behalf of the

appellant or the respondent either in the morning session or in

the afternoon session. It seems that the appellant has no interest

to prosecute the appeal.

3. Accordingly, the appeal is dismissed for default. No costs.

4. Miscellaneous petitions, if any, pending in this appeal shall stand

closed.
