              CIVIL MISCELLANEOUS APPEAL No.951 of 2016

JUDGMENT:

This appeal has been filed against judgment dated 02.09.2016 in

I.A.No.298 of 2016 in O.S.No.21 of 2016 on the file of Additional District

Judge, Bhimavaram.

2. There is no representation for the appellant on 07.03.2023. Even

today, there is no representation for the appellant, though the matter is

listed under the caption for dismissal.

3. Sri K.V.L Narasimha Rao, learned counsel for the respondent

submits that the suit was dismissed in the trial Court on 10.10.2018.

4. Learned counsel placed a copy of the case status particulars of

the trail court before this Court.

5. On perusal of the same, it appears that the suit in O.S.No.21 of

2016 was dismissed on 10.10.2018 in court of the III Additional District

Judge, Bhimavaram.

6. In view of the above factual position, it appears that this appeal

has become infructuous

7. Accordingly, this Civil Miscellaneous Appeal is dismissed as

infructuous. No costs.

As a sequel, miscellaneous applications pending in this civil

miscellaneous appeal shall stand closed.
