JUDGMENT:-
Heard Sri Sivaprasad Reddy Venati, learned counsel for
the petitioner and learned Government Pleader for Social
Welfare for the respondent No.1 and Sri Mohammed
Gayasuddin, learned counsel for the respondent No.2.
Undisputedly, the order passed by the Board appointing
the 4th respondent as Muthawalli can be challenged before the
Waqf Tribunal. The appointment of the 4th respondent is under
the Waqf Act, which also provides the remedy.
Consequently, this Court is not inclined to entertain the
writ petition, which is dismissed on the ground of existence of
alternative remedy.
It is open to the petitioner, if so advised, to avail such
remedy.
Accordingly, the writ petition is dismissed. No order as to
costs.
As a sequel thereto, miscellaneous petitions, if any pending,
shall also stand closed.
