Heard learned counsel for the petitioners and learned Additional Public Prosecutor.

There is a delay of 164 days in preferring the criminal appeal.

It is stated that due to poverty and illiteracy and as the petitioners are not aware of the legal procedure, this appeal could not be filed within time. Considering the reasons assigned explaining the delay, we are of the considered view that the delay of 164 days can be condoned by imposing some terms.

Therefore, the petition is allowed condoning the delay of 164 days in preferring the criminal appeal against the Judgment dated 30.09.2022 in S.C.No.06 of 2019 on the file of the VI Additional District and Sessions Judge- cum-Special Judge for the Trial of Offences against Women FAC, Special Judge for speedy trial of offences under POSCO Act, Chittoor, on payment of costs of Rs.1000/- payable to High Court Employees Association on or before 03.07.2023.
