JUDGMENT:- (Per Hon'ble Sri Justice Ravi Nath Tilhari )

1.    Sri.   M.R.S.      Srinivas,   learned     counsel        for   the

Appellants has submitted a 'Memo of Withdrawal', dated

17.07.2023, on record, submitting as follows:-

                        "MEMO OF WITHDRAWAL

          I am the counsel for the Appellant herein and I am
          well acquainted with the facts of the case. I filed
          the above Appeal A.S. No. 229 of 2017 before this
          Hon'ble Court aggrieved by the judgment and
          decree dt. 16.10.2016 passed in O.S. No. 20 of
          2013 on the file of Court of VI Addl. Dist. Judge,
          Anantapur. This matter is being pending before
          this Hon'ble Court as on today. My client has
          instructed me on dt. 01.05.2023 to withdraw the
          above Appeal. On the instructions of my client, I
          request this Hon'ble Court to allow me to
          withdraw the A.S. No. 229 of 2017 in the interest
          of Justice.

          Hence I pray before this Hon'ble Court to consider
          our request and allow us to withdraw the A.S.
          No.229 of 2017 and post this matter tomorrow for
          withdrawal and pass such other order or orders
          as this Hon'ble Court may deem fit and proper in
          the circumstances of the case."

2.   Sri. M.R.S. Srinivas, Advocate, submits that the

Appeal be dismissed as withdrawn.


3.   Sri. K. Dheeraj, Advocate, appearing on behalf of

Sri.O.   Manoher   Reddy,    learned   Counsel   for   the

Respondents, submits that he has no objection to the

withdrawal of the Appeal.

4. In view of the above, the Appeal is dismissed as

withdrawn.

No order as to costs.

Pending miscellaneous petitions, if any, shall stand

closed in consequence.
