JUDGMENT:
None appeared for the appellant.
2. Sri V.Venkata Subbaiah, learned counsel representing Sri
E.Sambasiva Pratap, learned counsel for the 1st respondent and
Sri P.Prabhakar Rao, learned counsel for the 3rd respondent, are
present.
3. On 01.02.2023, learned counsel for respondents present,
but none appeared on behalf of the appellant/plaintiff. Again
the matter was listed on 03.03.2023 and on that day also none
appeared for the appellant and learned counsel for respondents
present. On 27.03.2023 also none appeared on behalf of the
appellant as well no representation for the appellant. Then the
Court listed the matter to 12.04.2023, under the caption 'for
dismissal'.
4. When the matter was listed on 19.06.2023, none
appeared for the appellant and learned counsel for respondents
insisted for disposal. Then the matter was listed to this date
under the same caption 'for dismissal'. But, even today also
none appeared for the appellant either in the morning or in the
afternoon.
5. Hence, the appeal suit is dismissed for default. There
shall be no order as to costs.
6. Interim orders granted earlier if any, stand vacated.
7. Miscellaneous applications pending if any, shall stand
closed.
