JUDGMENT:-


1.    Despite the matter is posted to give fair opportunity

to   the   appellants   to   prosecute    the   Appeal,   no

representation on behalf of the Appellant Nos. 2 and 3.

The record shows that a memo has been filed by the

learned counsel for the Respondent No.2 on 25.02.2021

to the effect that the appellant No.1 died on 22.10.2020.

In spite of the same, no steps have been taken to

recognize the legal representatives of the appellant No.1

though the children of the appellant No.1 i.e., sons and

daughters are on record. The docket further shows many

a time this appeal has been posted under the caption for

dismissal, but there is no representation on behalf of the

Appellant Nos. 2 and 3. It appears, the appellants have

no interest in prosecuting the appeal. Therefore, the

appeal deserves dismissal.

2. Consequently, the Civil Miscellaneous Appeal is

dismissed. There shall be no order as to costs.
