WRIT PETITION No.1918 of 2023
JUDGMENT:-
It has been pointed out by Sri G.Naresh Kumar, learned
counsel representing the respondent No.3 that the English
translated copy of provisional order dated 18.01.2023, which is
challenged by the petitioner No.1, is incomplete. In the
vernacular, provisional order/notice, there is reference to
W.P.No.40434 of 2022 filed by the 3rd party against the
petitioners' father and the orders passed therein, but the same
has not been translated in English in the copy annexed.
2. The aforesaid has not been disputed.
3. The petition contains declaration at Page No.1 that "all
the documents annexed to the petition in vernacular are
accompanied by the English translation, true, correct and
complete in all respects".
4. What the Court finds is that the declaration is incorrect.
5. The writ petition is dismissed for the aforesaid reason,
however granting liberty to the petitioners as prayed, to file
fresh writ petition, complete in all respects.
No order as to costs.
As a sequel thereto, miscellaneous petitions, if any
pending, shall also stand closed.
