As against the concurrent judgments of both
the Courts below, the defendant in the suit preferred
this Second appeal. The prayer in the suit is one for
declaration of title and for recovery of possession
and other reliefs. The following substantial questions
of law do arise in this Appeal:
Whether the Courts below committed an error
in placing the burden of proof on the
defendant and arriving at conclusions on the
weakness of the defendant's case leading to
declaration of title and recovery of possession
in favour of the plaintiff/respondent herein
and thereby rendered perverse Judgments? Admit.
