          CIVIL MISCELLANEOUS APPEAL No.1225 OF 2008

JUDGMENT:

1. This Civil Miscellaneous Appeal is preferred against the

impugned order in O.P.No.26 of 1989 dated 17.09.1990 in un-

numbered suit on the file of the learned Subordinate Judge, Kovur.

2. Despite the matter is posted for "dismissal", today there

is no representaion on behalf of both the parties. The matter is called

again after the list is completed. Inspite of the same, there is no

representation. It appears that they have no interest in prosecuting

the Appeal.

3. Accordingly, the Civil Miscellaneous Appeal is dismissed

for default. There shall be no order as to costs.

As a sequel, interlocutory applications pending, if any, in this

Civil Miscellaneous Appeal shall stand closed.
