The learned counsel for the petitioner submits that the petitioner/appellant was convicted by way of impugned judgment, dated 05.09.2018 passed in S.C.No.20 of 2018 by the Metropolitan Sessions Judge- Cum-Special Judge for Trial of NDPS Act Offences, Vijayawada, under Section 8 (c) read with 20 (b)(ii)(C) of NDPS Act, and sentenced him to undergo Rigorous Imprisonment for a period of ten years and also to pay a fine of Rs.1,00,000/-, in default to suffer S.I for a period of six months. Right from the date of judgment, he is undergoing imprisonment and presently he is lodged in Central Jail, Rajamahendravaram.
2. The learned counsel for the petitioner contends that the petitioner has already been served more than 6 years of sentence. As the petitioner has already been served substantial sentence of imprisonment, this Court is
inclined to enlarge him on bail.
3. Therefore, pending the present Criminal Appeal, sentence of imprisonment alone is suspended and the appellant is directed to be released on bail on his executing a personal bond for Rs.20,000/- (Rupees Twenty Thousand only) with two (02) sureties for a like sum each to the satisfaction of the learned Metropolitan Sessions Judge- Cum-Special Judge for Trial of NDPS Act Offences, Vijayawada.
4. Accordingly, this application is disposed of.
