This application is filed seeking to
suspend the judgment passed in Special
SC.No.74 of 2017, dated 11.10.2023 by the
Special Judge for Trial of Cases under SCs &
STs (POA) Act, 1989-Cum-X Additional
District Judge Krishana at Machilipatanam,
whereby and whereunder, the Trial Court
acquitted the respondent Nos.2 and
3/Accused Nos.1 and 2 for the offence punishable under Sections 307, 420 of IPC, under Section 3 (1) (r), Section 3(1)(s) and Section 3 (2)(va) of SCs & STs (POA) Act, 1989. Since, the relief prayed in this application, in the considered view of this court, is misconceived, as the present appeal is filed by the de-facto complainant against
the acquittal.
Accordingly, this application is dismissed.
