Learned counsel for the appellant filed
proof of service stating that In view of the
Apex Court judgment reported in C.C.Alavi
Haji Vs. Palapetty Muhammed and
another - (2007) 6 SCC 555, held that
when a notice is sent by registered post and is
returned with a postal endorsement "refused"
or "not available in the house" or "house
locked" or "shop closed" or "addressee not in
station", due service has to be presumed.
As per the above judgment, notice sent
to Respondent Nos.1, 3 and 4 are deemed to
have been served as per law.
Respondent No.4 is minor, represented by his mother, who is 1st respondent.
In view of the above judgment, it appears as deemed service of the respondents concerned as per law.
ADMIT.
Notice.
Post the matter on 12.12.2023, for "final hearing".
