APPEAL SUIT No.203 of 2015 JUDGMENT:- (per Hon‟ble Sri Justice Ravi Nath Tilhari)

The matter pertains to the year 2015.

2. Sri E. V. V. S. Ravi Kumar, learned counsel for the

appellant had given No Objection Certificate (NOC) for filing

fresh vakalat in favour of the another counsel to the appellant.

3. Previously, the matter was adjourned on the request

made on behalf of the appellant's counsel due to his illness.

4. On 27.07.2023, the order was passed giving opportunity

to the appellant to make an alternative arrangement.

5. On 17.08.2023, it was informed to this Court that

Sri E. V. V. S. Ravi Kumar has already given No Objection

Certificate (NOC) in the year 2020 itself. The following order

was passed on 17.08.2023:-

"1. Ms. R. D. Latha, learned counsel appearing on behalf of Sri E. V. V. S. Ravi Kumar, learned counsel for the appellant(s) submits that No Objection Certificate (NOC) to engage other counsel was given way back in the year 2020 to the appellant(s).

2. It appears that the appellant(s) has yet not engaged any other the counsel.

3. List on 24.08.2023 under the caption „for dismissal‟."

6. The appellant has yet not engaged any other counsel

inspite of so many opportunities and also taken no objection

from the previous counsel in the year 2020.

7. Under the circumstances the appeal is dismissed for

"want of prosecution".

8. Let the record of the Trial Court be sent back, if received.

No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending,

shall also stand closed.
