Learned counsel for the petitioner is present.

At the time of hearing, learned Assistant Public Prosecutor stated that due to the stay granted by this Court earlier, the investigation is stalled.

In view of the judgment of the Hon'ble Supreme Court of India in Asian Resurfacing of Road Agency Private Limited and Another v. Central Bureau of Investigation (2018) 16 SCC 299, stay is not in force. The concerned SHO is directed to proceed with the investigation in accordance with law.

Post these matters on 13.05.2023.
