      THE HON'BLE SRI JUSTICE BANDARU SYAMSUNDER

 CIVIL REVISION PETITION Nos.464 OF 2015 and 4428 OF 2015

COMMON ORDER:

       Learned counsel Mr.K.Venugopal Reddy, represented for the

revision petitioners that he filed petition to add legal representatives of

deceased revision petitioners.


       Learned counsel Mr.A.V.Pardha Saradhi, represented on behalf

of Mr.D.Krishna Murthy, learned counsel for the respondents in

C.R.P.No.464 of 2015, who informed this Court that suit O.S.No.135 of

2014 on the file of Additional Senior Civil Judge, Kurnool is dismissed

as abated. He also produced copy of Judgment and Decree in

O.S.No.135 of 2014, dated 06.07.2022, which shows suit is dismissed

as abated and no order as to costs. This Court also verified "e" Courts

web site pertaining to District Court, Kurnool in respect of O.S.No.135

of 2014 on the file of Senior Civil Judge, Kurnool, which shows that the

advocate for the plaintiff reported that as all the defendants died, the

defendant society become defunt. Hence, suit may be dismissed. In

view of representation of the plaintiff that all the members of society of

D.1 died society stand dissolved. Accordingly, suit is dismissed as

abated.

Suit which filed by the respondents seeking permanent

injunction against revision petitioners/defendants itself is dismissed

automatically any interim injunction is granted also stands closed. In

view of dismissal of main suit No.135 of 2014 itself no lis survives to

adjudicate in the present civil revision petitions, which preferred

against orders passed in C.M.A.No.8 of 2014 on the file of I Additional

District Judge, Kunoor, which Court confirmed interim injunction

granted by Additional Senior Civil Judge, Kurnool in I.A.No.177 of

2014.

In the result, the Civil Revision Petitions are dismissed as

infructuous. No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall

stand closed.
