JUDGMENT:

On 19.07.2022 as there was no representation, the matter was

directed to be listed under the caption 'for dismissal' to 20.07.2022. On

that day also, as there was no representation, again posted the matter

under the same caption to 25.07.2022. Even on 25.07.2022, as there was

no representation on behalf of the appellant either forenoon or

afternoon, the matter was directed to be listed on 27.07.2022 under the

same caption. When the matter was listed on 16.09.2022, as there was

no representation on either side, directed to be listed to 29.08.2022.

When the matter was listed on 01.09.2022, there was no representation

on either side. In order to give one more opportunity, this Court directed

to be listed the matter on 09.09.2022 under the caption 'for dismissal'.

Even today also, there is no representation on either side.

2. In spite of listing the matter several times under the caption 'for

dismissal', there is no representation for the appellant. Hence, the Civil

Miscellaneous Appeal is dismissed for non-prosecution. No costs.

3. Interim orders granted earlier if any, stand vacated.

4. Miscellaneous applications pending if any, shall stand closed.
