JUDGMENT:

Aggrieved of the judgment and decree dated 17.12.2012

passed in O.S.No.1160 of 2010 on the file of the Court of I

Additional Senior Civil Judge, Vijayawada, the

appellant/defendant had filed this appeal.

2. During the pendency of this appeal, the parties had

entered into compromise and had settled the matter out of

Court and moved I.A.No.1 of 2022 requesting to dispose of the

appeal in terms of the compromise. The terms of the

compromise are reduced into writing by way of a Memorandum

of Compromise and the same is placed on record.

3. The petitioner/appellant and respondent/plaintiff are

present before this Court. They also produced proofs in regard

to their identity. Both the parties submit that they have agreed

the terms and conditions mentioned in the memorandum of

compromise and after satisfying the contents therein they

singed in memorandum of compromise. The parties are duly

represented by their respective counsel.

4. The learned counsel for both the parties had submitted

that since the parties have settled the matter out of Court and

had entered into compromise, the main appeal be disposed of in

terms of the compromise memo.

5. Recording the said submission, I.A.No.1 of 2022 is

ordered. Consequently, the appeal is disposed of in terms of

the compromise. The Memorandum of Compromise shall form

part of this judgment and decree. There shall be no order as to

costs.

6. Registry shall issue certified copy of this judgment along

with Memorandum of Compromise and also prepare the decree

as per the compromise terms.

7. Interim orders granted earlier if any, stand vacated.

8. Miscellaneous petitions pending if any, stand closed.
