WRIT PETITION NO.12433 OF 2022
ORDER:
This petition is filed under Article 226 of the Constitution of
India, seeking to declare the proceedings of the 2nd respondent in
draft memo No.G2/19134/2011 dated 01-12-2011 as illegal,
without jurisdiction and unconstitutional and to issue
consequential direction to the 4th respondent to receive and
register the document that may be presented by the petitioner for
registration in respect of the nearest dr No:9-3, 9th ward, for an
extent of Ac.0.04 cents in Sy.201 of Podili village and Mandal,
Markapur Revenue Division, Prakasam District, without reference
to the memo of the 2nd respondent bearing No.G2/19134/2011
dated 01-12-2011.
2. During the course of hearing, learned counsel for the
petitioner submits that the subject matter of the writ petition is
squarely covered by the order of this Court dated 30.01.2020
passed in WP No.1981 of 2020.
3. Learned Government Pleaders did not oppose the said
submission.
4. Having regard to the facts and circumstances of the case,
considering the submissions made and in the light of the above
order of this Court, the impugned proceedings are hereby set aside
while directing the 4th respondent to receive and register, if it is not
prohibited by any order or law, the document by following the
principles laid down in the judgments referred in the said Writ
Petition.
5. With the above direction, the Writ Petition is disposed of,
without touching the merits in the title of the petitioner. No costs.
6. The Registry is directed to attach a copy of the order in
W.P.No.1981 of 2020, dated 30.01.2020 to this order.
As a sequel, miscellaneous applications pending, if any, shall also stand closed.
