S.A.No.620 of 2021
Heard Sri P.Durga Prasad, learned counsel for the
appellants.
ADMIT.
The following are the substantial questions of
law:
1. Whether the findings of the lower appellate Court
are in consonance with the mandatory provisions
of Order-41, Rule-31 CPC as the lower appellate
Court failed to assail cogent and convincing
reasons for reversing the findings of the trial
Court?
2. Whether the lower appellate Court is justified in
reversing the judgment and decree of the trial
Court without appreciating the oral and
documentary evidence available on record from
proper perspective?
3. Whether the finding of the lower appellate Court
on the exhibits marked on behalf of the plaintiff
and the defendant are in consonance with the
evidence let in by the respective parties and it
can be said that the findings are perverse?
4. Whether Article-54 of the Limitation Act than
Article-52 applies to the given facts and
circumstances of this case?
Notice to respondent.
