Writ Petition No.3042 of 2022
ORDER:
Heard the learned counsel for the petitioner and the
learned Government Pleader.
2. After obtaining instructions, it was agreed that
there is an order passed in favour of the petitioner in
O.S.No.42 of 2020 on the file of Junior Civil Judge,
Madakasira. For ensuring that this order is complied with,
the petitioner is seeking police aid. Despite representations,
the same is not granted.
3. The learned counsel for the petitioner relied upon
an order passed in W.P.No.15603 of 2020 and batch ,wherein
the learned Single Judge after considering the entire law on
the subject held that once there is a permanent injunction
decree, the petitioner can directly approach the High Court
instead of going to the Civil Court once again. In view of the
settled position of law, this Court is of the opinion that the
Writ Petition should be allowed.
3. Accordingly, the Writ Petition is allowed with a
direction to Respondent Nos.2 to 4 to provide police aid to the
petitioner for effective implementation of the permanent
injunction granted by the Judgment and decree
dated 24.03.2021 in O.S.No.42 of 2020 passed by the Hon'ble
Junior Civil Judge, Madakasira. No costs.
As a sequel thereto, the miscellaneous petitions, if any,
pending in this Writ Petition shall stand closed.
