SECOND APPEAL No.1669 of 2004
JUDGMENT :
Smt. Uma Devi, learned counsel appearing virtually on
behalf of Sri G. Rama Gopal, learned counsel for the appellants,
stated that the appellants as well as the 1st respondent in this
case died and so far they are unable to bring the legal
representatives of the appellants as well as the legal
representatives of 1st respondent-deceased on record. She further
stated that she would file L.R petitions as and when the L.Rs
approach her, the second appeal may be dismissed for non-
prosecution by giving liberty to file set aside abatement petition
along with limitation, whenever the L.Rs are available to bring
them on record.
2. Heard the learned counsel for the appellant.
3. Since the appeal pertains to the year 2004, the liberty as
prayed for by the learned counsel for the appellants cannot be
granted and the same is rejected.
4. Accordingly, the Second Appeal is dismissed as non-
prosecution. No order as to costs.
Miscellaneous petitions pending, if any, in this Appeal,
shall stand closed.
