Sri D.Krishna Murthy, learned counsel for the petitioners, submits that the impugned order of the Tahsildar itself states that the land in question vests with the Gram Panchayat. He further relies on a judgment of a Division Bench of this Court reported in 1982 AIR AP page 15 to contend that such land vests in the Gram Panchayat. He submits that once the land vests in the Gram Panchayat, the revenue authorities cannot invoke the provisions of the A.P.Land Encroachment Act, 1905 and as such all the proceedings would have to fail.
Learned Assistant Government Pleader for Revenue submits that by virtue of G.O.Ms.No.188, the revenue authorities would still be entitled and have jurisdiction to invoke the provisions of the Land Encroachment Act, 1905, in relation to the land in the possession of the petitioners. He seeks time to place such Gram Panchayat before the Court.

In the meanwhile, the petitioners shall not be dispossessed from the land for a period of one week.
