Submission of the learned counsel for the
petitioner is that the leases of 64 shop rooms
granted by the 3rd respondent-Greater
Visakhapatnam Municipal Corporation in favour of different lessees have expired, whereas those persons are still occupying the shops for more than 30years.
He submits that as per Section 148 (3) of Municipal Corporation Act, 1955 lease cannot be extended beyond the period of 25 years and in view of the Judgments of this Court, the same has to be put to public auction for settlement.
He further submits that the respondent No.3 issued notice for eviction in the year 2015 itself, but no further action is taken by the respondent No.3.
Sri S.Laxminarayana Reddy, learned Standing Counsel submits that two weeks time may be granted so as to obtain instructions as in many cases those lessees have filed writ petitions in which there are interim orders.
