judgment. From the contentions raised in this
Second Appeal and the material on record, the
substantial questions of law that fall for
consideration
1. In the context of admission of signature
on Ex.A1 by the respondent whether the
trial Court and the First Appellant court erred in ignoring its effect?
2. Whether the courts below failed to exercise power vested with them under section 73 of the Indian Evidence act resulting the negating the claim of the appellant.
3. Did the courts below fail to notice the presumption under section 118 of the Negotiable Instruments Act. On these points, the Second Appeal is admitted.
Learned counsel for the appellant is permitted to take out personal notice to the respondents and file proof of service into the registry.
