APPEAL SUIT No.2438 of 1999
JUDGMENT:
Sri P.Madhusudhan, learned counsel for 2nd respondent
would submit that the 2nd respondent died on 10.10.2020 and
to that effect a memo was filed vide USR No.62682 of 2021
dated 06.12.2021. As per the record, 1st respondent also died.
Going by the cause title, respondents 3 to 6 are not necessary
parties to the appeal.
So far no petition is filed by the appellant to bring legal
representatives of deceased respondents on record. Apart from
that, this appeal suit was posted on 11.07.2022 and as there
was no representation, the appeal was listed on 18.07.2022. On
that day, at request of learned counsel for appellant, the appeal
was adjourned to 25.07.2022. Again on 27.07.2022 as there
was no representation on behalf of appellant, the matter was
listed today under the caption "For Dismissal". Today also
there is no representation on behalf of the appellant. It seems
that the appellant is not interested to prosecute the appeal.
In view of the same, the appeal suit is dismissed for non-
prosecution. No costs.
As a sequel, all the pending miscellaneous applications
are closed.
