I.A.No.1 of 2022 The learned counsel for the petitioner submits that the delay in filing the appeal is due to illiteracy and that the appellant/ accused, since the date of conviction judgment pronounced on 23.08.2018 was committed to prison and his father, who is a daily wage labour does not know the legal remedies available to the appellant and hence he did not take steps to prefer the appeal in time.
The learned Special Assistant Public Prosecutor submits that though the delay of 1374 days in preferring the appeal is inordinate, the same may be condoned in order to do substantial justice.
In view of the submissions made by both the counsel, this petition is allowed and the delay of 1374 days in preferring the Criminal Appeal is condoned.
