The petitioners, who are accused 1 to 3 in C.C.No.232 of 2016 on the file of the II Additional Judicial Magistrate of First Class, Tirupati, Chittoor District, were convicted for the offence punishable under Section 411 of IPC and they were sentenced to undergo simple imprisonment for a period of three months each. Appeal preferred against the said judgment of conviction and sentence in Crl. Appeal No.57 of 2019 on the file of the III Additional Sessions Judge, Tirupati, came to be dismissed by the impugned judgment of conviction.

Aggrieved thereby, the present criminal revision case is preferred by the petitioners. The petitioners are on bail throughout in the trial Court and also during the course of appeal.

Therefore, in the said facts and circumstances of the case, this petition is allowed and only the execution of substantive sentence of imprisonment imposed against the petitioners in C.C.No.232 of 2016 on the file of the II Additional Judicial Magistrate of First Class, Tirupati, which in turn was confirmed in Crl. Appeal No.57 of 2019 on the file of the III Additional Sessions Judge, Tirupati, is hereby ordered to be suspended till the disposal of this criminal revision case.

The petitioners/accused 1 to 3 shall be released on bail on execution of a self bond for Rs.25,000/- (Rupees twenty five thousand only) each with two sureties for a like sum each to the satisfaction of the learned II Additional Judicial Magistrate of First Class, Tirupati.
