                    A.S. No.731 of 2017

JUDGMENT:

The appellant herein had filed O.S.No.31 of 2013 in

the Court of the Principal Senior Civil Judge, Guntur, for

recovery of a sum of Rs.6,05,108/- along with subsequent

interest from the respondents herein. This suit was dismissed

by the judgment and decree of the trial court dated 28.04.2017.

Aggrieved by the same, the appellant had preferred the present

appeal in As.No.731 of 2017.

2. It is now stated by Sri K. Rajasekhar, learned

counsel for the Appellant, representing Sri.Seshagiri Rao Ullam

that the defendants had paid the entire amount due to the

appellant, and as such, nothing remains in the present appeal.

An affidavit to this effect has also been filed by the Branch

Manager of the Appellant in I.A.No.1 of 2021, wherein it is

stated that the loan account has been cleared and a request has

been made to the counsel appearing for the appellant to

withdraw the appeal and to file an application for return of the

original documents lying with the Court so that they can be

returned to the account holder.

3. In these circumstances, this appeal is dismissed as

withdrawn with a further direction to the Registry to return the

original documents, marked in the trial of the suit, after the

appellant substitutes the same with the certified copies of the

said documents. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall

stand closed.
