7. 02.09.2021 I.A.No.2 of 2021
This is an application seeking leave to appeal
against the judgment dated 05.03.2021 passed by the
learned single Judge in W.P.No.23770 of 2017 and other
connected cases, so far as it relates to W.P.No.33349 of
2018.
Heard Mr. Ganta Rama Rao, learned Senior Counsel
appearing for the appellant.
Also heard Dr.P.B.Vijay Kumar, learned counsel for
the respondent No.4/writ petitioner, and Mr. Syed Khader
Masthan, learned Government Pleader attached to the office of learned Additional Advocate General appearing for State of Andhra Pradesh as well as Andhra University, arrayed as respondent Nos.1 and 2.
W.P.No.33349 of 2018 was filed challenging the recruitment process initiated by Andhra University, in which the appellant had taken part. The recruitment process was cancelled and this was noticed by the learned single Judge.
Mr. Ganta Rama Rao submits that though the same was noticed by the learned single Judge and had observed that the case would not require further consideration, discussions arising in other writ petitions had overlapped consequently affecting the right of the appellant to contest and challenge the cancellation of the recruitment process in as much as in view of the observations made by the learned single Judge in the order, even if any challenge is mounted challenging the cancellation of recruitment process, the appellant would not have been entitled to a favourable outcome. It is in these circumstances, Mr. Ganta Rama Rao submits that leave to appeal may be granted.
The application is not opposed by the learned counsel appearing for the parties.
