JUDGMENT: (Heard and pronounced through Blue Jeans App (Virtual)
          mode, since this mode is adopted on account of prevalence of
          COVID-19 pandemic)

      On 21.10.2021 as the counsel for the appellant was not available online, the

matter was directed to be listed on 23.10.2021 under the caption "for orders". On

23.10.2021

as there was no representation on behalf of the appellant, the matter

was directed to be listed on 25.10.2021 under the caption "for dismissal". As there

was no representation again on 25.10.2021 though the matter was listed under the

caption "for dismissal", to give an opportunity the matter was directed to be listed

on 27.10.2021 under the same caption. Even today, there is no representation on

behalf of the appellant.

In view of the above, the M.A.C.M.A. is dismissed for non-prosecution. No

order as to costs.

Consequently, miscellaneous petitions, if any, pending in the appeal shall

stand disposed of.
