                         WRIT PETITION NO.23725 OF 2021
ORDER:

This writ petition is filed under Article 226 of the Constitution

of India seeking the following relief:

"To issue Writ of Mandamus declaring the action of the 3rd respondent in not deciding petitioners Revision Petition dated 16.12.2020 filed against the endorsement in Rc A/441/87 dated 20.10.2020 issued by the 4th respondent filed under the provisions of Section 9 of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 as illegal irregular irrational and amounts to non discharge of legal obligation conferred on him under said statute and offends Article 14 of Constitution of India and consequently direct the 3rd respondent to decide petitioners pending Revision Petition dated 16.12.2020 in accordance with law"

Though the petitioner made several allegations against the

respondents, during hearing, Ms. Nimmagadda Revathi, learned

counsel for the petitioner limited her request to dispose of the

Revision Petition dated 16.12.2020, without touching the merits of

the case.

Learned Assistant Government Pleader for Revenue appearing

for respondents readily agreed to dispose of the Revision Petition

dated 16.12.2020 filed by the petitioner, if any, pending with the

respondent-authorities.

Recording the submissions of the learned Government Pleader

for Revenue, I need not decide the truth or otherwise of the

allegations made in the petition. This Court is conscious that no

such direction be issued, in view of the judgment of the Apex Court

in "The Government of India v. P.Venkatesh1", wherein the Apex

Court held that such orders may make for a quick or easy disposal of

cases in overburdened adjudicatory institutions. But, they do not

serve to the cause of justice. As the learned counsel for the petitioner

herself requested to issue a direction to dispose of the Revision

Petition dated 16.12.2020 filed by the petitioner, I find no other

alternative, except to issue such direction.

In the result, the writ petition is disposed of, directing the

fourth respondent - Tahsildar, Tiruvuru Mandal, Krishna District, to

dispose of the Revision Petition dated 16.12.2020 filed against the

endorsement in Rc.A/441/87 dated 20.10.2020, in accordance with

law, within eight (08) weeks from the date of receipt of a copy of this

order. No costs.

Consequently, miscellaneous applications, pending if any,

shall stand closed.
