The appellants are the unsuccessful
plaintiffs in O.S.No.12 of 2017 before the II Additional District Judge, Parvathipuram. This suit was filed for specific performance of sale dated 18.10.2016. However, the same was dismissed by a Judgment and decree dated 22.11.2019 by the trial Court. Aggrieved by the same, the appellants have filed the present appeal and have also filed an application to injunct the defendant from alienating the suit schedule property pending the appeal. The appellants have served notice of the present appeal on the respondents on 12.08.2021.
There is no appearance for the respondent on 24.08.2021 and today when the matter is called.
In view of the fact that the suit was for specific performance, the alienation of the said property would result in multiplicity of proceedings and as such, an injunction pending the appearance of the respondents would be appropriate.
Accordingly, an injunction restraining the respondent from alienating the suit schedule property is granted for a period of six weeks.
