Petition under Section 151 CPC praying that in the circumstances stated in the
affidavit filed in support of the petition, the High Court may be pleased to direct the
respondents 3 to 6 not to release the benefits under the policy numbers 845828411,
633991139 (LIC-3" and 4" respondents 20980126 (HDFC-5" respondent), 266676659
(MAX- 6" respondent), to respondents 7 and 8 and pass such order or orders as this
Hon'ble court May deem fit and proper in the circumstances of the case, pending
disposal of WP No.26730 of 2021, on the file of the High Court.
The court while directing issue of notice to the Respondents herein to show
cause as to why this application should not be complied with, made the following
order.(The receipt of this order will be deemed to be the receipt of notice in the case).
ORDER:
"It is submitted by the learned counsel for the petitioner that the
petitioner's husband lost his life on 18.08.2021 and the respondent authorities are
contemplating to pay the entire insurance amount to respondent Nos.7 and 8 and
contrary to the law laid down by the Hon'ble Supreme Court reported in AIR 1984
SC 346 and judgment of Patna High Court in Civil Writ Judicature Case No.12012
of 2018 dated 25.09.2019. This issue requires consideration.
in view of the above submissions, there shall be interim direction as prayed
