The petitioner is the de facto complainant in S.C.No.2 of 2018 on the file of the learned Special Sessions Judge for trial of cases under SC and ST Cases (POA) Act - cum - XI Additional District and Sessions Judge, Visakhapatnam. He has filed a petition before the trial Court under Section 311 Cr.P.C to recall him as a witness, who is examined as P.W.1, for the purpose of producing the caste certificate and to mark it as a piece of evidence. The said certificate is now produced to prove that he belongs to Scheduled Caste. The said petition came to be dismissed by the impugned order. It is brought to the notice of this Court by both the counsel that the matter is posted to this day for arguments.

Therefore, there shall be interim stay of pronouncement of the judgment in the above case till 09.11.2021.
