The following is the substantial question of law:-
Whether it is necessary for plaintiff to file a separate suit for declaration when the plaintiff's suit for partition with respect to same property is partly decreed and an appeal is pending with respect to remaining share of the plaintiff?
It is informed by both the counsel that A.S.No.233 of 2002 is pending on the file of this Court to which the parties to this appeal are also parties, preferred against the decree and judgment in O.S.No.93/2001 on the file of the Senior Civil Judge, Kavali. Therefore, the Second Appeal is directed to be tagged to A.S.No.233 of 2002 for consideration and determination.
List both the matters two (02) weeks later.
Registry to obtain orders of the Hon'ble the Chief Justice to tag this appeal with the first appeal.
