Petition under Section 151 CPC praying that in the circumstances stated in the
affidavit filed in support of the petition, the High Court may be pleased to direct the
principal Junior Civil Judge at Narasaraopet, to dismiss the suit in O.S No.263 of 2020
filed by the plaintiff by vacating ad-interim injunction passed in |.A No.364 of 2020 in
O.S No.263 of 2020 dated 28.12.2020, pending disposal of CRP 303 of 2021, on the file
of the High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit
filed in support thereof and upon hearing the arguments of Sri G Elisha Advocate for the
Petitioner and of Sri G Tuhin Kumar Advocate for the Respondent and the Court made
the following.

ORDER:

"The matter is pertaining to the jurisdiction of the court and the learned senior counsel appearing on behalf of the petitioner relied on two judgments passed by this Court: ,

On the other hand, learned counsel appearing on behalf of the respondents contested the same, and vehemently argued that said judgments relied by the petitioner' counsel are over ruled by the Hon'ble Supreme court.

In view of the submissions made by both the counsel, as it is a contested matter, it has to be heard at length. Hence, post on 16.06.2021 for final disposal of the matter.

As per the undertaking given by the both the counsel, the matters would be heard on that day finally. .
