Petition under Section 397 (1) of Cr.P.C praying that in the circumstances stated
in the affidavit filed in support of the petition, the High Court may be pleased to suspend
the Judgment dated 26.02.2021 in Cri.A.No.441 of 2017 on the file of V Additional
District and Sessions Judge-cum-Special Judge for Trail of Offences Against Women,
Guntur in confirming the conviction and sentence passed on 26.10.2017 in C.C.No.866
of 2015 on the file of IV Additional Junior Civil Judge, Guntur, pending disposal of
CRLRC No.222 of 2021, on the file of the High Court.
The petition coming on for hearing, upon perusing the Petition and the affidavit
filed in support thereof and upon hearing the arguments of SRI ARUN SHOWRI
GORREMUCHU Advocate for the Petitioner and of PUBLIC PROSECUTOR for the
Respondent, the Court made the following
ORDER:
"Heard.
The sentence of imprisonment against the petitioner/A-1 in C.C.No.866 of 2015
dated 26.10.2017 on the file of IV Additional Junior Civil Judge, Guntur as confirmed
in Criminal Appeal No.441 of 2017 dated 26.02.2021 on the file of the Court of V
Additional District & Sessions Judge-cum-Special Judge for Trial of Offences Against
Women, Guntur alone is suspended pending the criminal revision case on condition
of petitioner surrendering before the IV Additional Junior Civil Judge, Guntur and on
such surrender, the petitioner shall be released on bail on the same day, on his
executing a bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two
sureties each for a likesum to the satisfaction of the learned IV Additional Junior Civil
