               SECOND APPEAL No.90 of 2021


JUDGMENT:

Learned counsel for the appellants seeks permission of

this Court to withdraw this Second Appeal with a liberty to file a

fresh suit.

Permission is accorded.

Accordingly, the Second Appeal is dismissed as

withdrawn giving such liberty. In case of filing a fresh suit, the

appropriate Court shall deal with the same in accordance with

law. There shall be no order as to costs.

Consequently miscellaneous applications pending, if any,

shall also stand closed.
