Heard learned counsel for the petitioner,
Mr.N.Ashwani Kumar, learned standing counsel for
respondent No.2 and Mr.M.Manohar Reddy, learned
standing counsel for respondent No.4.
In view of the settled case law on the subject
starting from the Judgment reported in
N.P.Ponnuswami vs Returning Officer1 including the
Full Bench Judgment of the High Court of Judicature at
Hyderabad reported in Kalla Ramakrishna vs State
Election Commission2, and even in case of improper
rejection of a nomination paper, the writ petition is not
maintainable.
In that view of the matter, after hearing the
learned counsel for the petitioner, this Court is of the
opinion that the writ petition is not maintainable and
can be dismissed at the stage of admission.
Hence, the writ petition is dismissed at the stage
of admission, leaving it open to the petitioner to
pursue his legal remedies as per law. There shall

be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if
any, pending in this Writ Petition shall stand closed.
