ORAL JUDGMENT

Heard Mr.P.Subash, learned Government Pleader appearing for the

appellants.

Also heard Mr. Dammalapati Srinivas, learned Senior Counsel

assisted by Mr. T. Ramesh Babu - learned counsel for the respondent/writ

petitioner.

On 23.06.2021, this Court had passed the following order:

"Heard Mr. P. Subash, learned Government Pleader

appearing for the appellants.

Also heard Mr. Dammalapati Srinivas, learned senior counsel appearing for the respondent/writ petitioner.

Mr. Dammalapati Srinivas submits that the writ appeal has been rendered infructuous in view of passing of an order by the authorities in terms of the order of the learned single Judge.

Mr. P. Subash, on the other hand, contends that alleging non-compliance of the order of the learned single Judge, Contempt Case No.403 of 2021 was filed by the respondent/writ petitioner and if that be the position, it cannot be argued that the writ appeal has been rendered infructuous.

Mr. Dammalapati Srinivas prays for some time to get instructions.

List this case on 25.06.2021 for motion hearing."

Today, Mr. Dammalapati Srinivas, learned Senior Counsel, submits

that C.C.No.403 of 2021 was filed prior to passing of the order by which

the representation filed by the writ petitioner was disposed of and, in any

event, the writ petitioner will not pursue C.C.No.403 of 2021. He further

submits that the writ petitioner will take steps to challenge the order by

which the representation was disposed of and, in the aforesaid

circumstances, the writ appeal is rendered infructuous.

Mr.P.Subash, in view of the above submissions of

Mr. Dammalapati Srinivas, learned Senior Counsel, also agrees that there

is no surviving cause of action in the present writ appeal.

In that view of the matter, the writ appeal stands disposed of as

infructuous. No costs. Pending miscellaneous applications, if any, shall

stand closed.
