Respondents (Respondents in-do-) Petition under Section 482 of Cr.P.C praying that in the circumstances stated in the memorandum of grounds of criminal revision petition, the High Court may be pleased to suspend the operation of the Judgment dated 10.4.2019 made in C.C.No.434/2016 on the file of the Special Judicial Magistrate of First Class (for Prohibition & Excise), Kurnool affirmed by the order dated 17.05.2021 made in Crl.Appeal No.48/2019 on the file of the Special Judge for Trial of Cases under SCs & STs (PoA) Act -- cum -- VI Additional Sessions Judge, Kurnool, pending disposal of CRLRC No.368 of 2021, on the file of the High Court. The petition coming on for hearing, upon perusing the Petition and memorandum of grounds of criminal revision petition and upon hearing the arguments of Sri N.Subba Rao, Advocate for the Petitioner and Public Prosecutor for the Respondent No.2, the Court made the following. ORDER:
"Heard learned counsel for the petitioner. As the issues urged in the grounds of Criminal Revision Case require detailed examination, the order dated 10.04.2019 passed in C.C.No.434 of 2016 on the file of the learned Special Judicial Magistrate of First Class (Prohibition & Excise), Kurnool, which is confirmed by the order dated 17.05.2021 in Criminal Appeal No.48/2019 on the file of the learned Special Sessions Judge for trial of cases under SC & STs (POA) Act-cum-V! Additional District & Sessions Judge, Kurnool, shall remain suspended on the condition of the petitioner depositing an amount of Rs.1,80,000/- (Rupees One Lakh and Eighty Thousand Only) to the credit of C.C.No.434 of 2016 before the learned Special Judicial Magistrate of First Class (Prohibition & Excise), Kurnool, within a period of four (4) weeks from today."
